No provision of Union law imposes a precise constitutional model on Member States. Under Article 4(2) TEU, the Union respects the national identity of Member States, inherent in their fundamental structures, political and constitutional. However, in choosing their constitutional models, Member States may not undermine the common values enshrined in the Treaties and the Charter of Fundamental Rights of the European Union.
