Rezumat

Although at least declarative, in a century of rapid progress and digitized procedures for access to justice, any national legislator would wish to avoid regulations that impose significant time-frames for resolving cases, since time-consuming judicial proceedings require financial support from a much broader spectrum of taxpayers than just those directly involved as litigants, we observe that courts are increasingly handling more complex cases, where a fair and equitable solution demands an investigation spanning considerable periods of time. Before 1989, under a regime where private property was not a recognized category in the domestic legislative framework, and disputes with a foreign element were truly exceptional, procedures did not require significant time-frames to reach a final verdict. However, the transition to an economy based on trade and free enterprise has necessitated substantial changes to procedural norms.
