Rezumat

Freedom of expression, also enshrined in the Constitution, is the possibility for us, the people, to express our thoughts, opinions, religious beliefs and spiritual creations of any kind through speech, writing, images, sounds or other means of communication in public. At the same time, freedom of expression also plays a fundamental role in the activity of creators of literary, artistic or scientific works. But, as we will present in our analysis, the exercise of freedom of expression by authors of literary, artistic or scientific works is not total, it is not absolute. In some cases, expressly provided for by law, when it is found that this fundamental right may infringe the rights of authors of literary, artistic or scientific works, certain protective measures may be ordered. In this sense, in the field of copyright, in order to protect the fundamental interests of creators in the literary, artistic or scientific field, the Romanian legislator has recognized the pre-eminence of moral rights.
